A man a court accused of raping a woman because he improperly used a condom during sex has been sentenced to 12-month Suspension _ You’re not going to believe what she claims happened.

The Switzerland court has convicted a man they say rape a woman because he took off the condom during sex without the consent of his partner.

The court finds the 47-year-old unknown man guilty after determining sex without a condom is same as rape if the use of a condom was part of the plan before intercourse. Therefore, had the woman know the condom was coming off, she would have stopped by not continuing to have sex with him.

The two had met on a dating app called Tinder. He’s from France and she’s from Swiss. The man was sentenced this week, but the alleged crime happened in June 2015 on their second date. According to reports, the woman claimed she didn’t know the condom was removed until after they were done.

The court gave him a 12-month suspension as a result of his negligence. Rape convictions are rare and consent is often a woman’s burden to prove. Be sure to check your local laws before thinking about removing a condom during sex.
